(“we”, “us”, “our”)
These Terms and Conditions apply to all removalist, moving, and packing services provided by
MANIFESTO CONSTRUCTIONS PTY LTD (“Company”) to the customer (“you”, “your”).
By making a booking via our website, phone, or any other method, and by ticking the acceptance
checkbox where applicable, you acknowledge that you have read, understood, and agreed to these
Terms and Conditions.
1. Services Provided
We provide the following services:
- Residential moving
- Office and commercial moves
- Local moves
- Interstate moves
- Same-day and scheduled deliveries
Services are provided on the agreed booking date and time, subject to access, weather, traffic,
and other factors beyond our reasonable control.
2. Quotations & Pricing
2.1 Pricing Structure
- Charges are calculated on a half-hourly basis at $69.50 per half hour excluding GST.
- A minimum booking of 30 min applies to all jobs.
- A 30 min call-out fee applies to each booking.
- There are no additional charges for stairs or difficult access.
2.2 Weight & Labour
- Each removalist is able to lift and carry items up to 50kg.
- Items exceeding this weight may require additional removalists.
- If additional labour is required, charges will apply at the standard hourly rate.
2.3 Estimates
- Any quote or estimate provided is an estimate only, based on information supplied by you.
- Final charges may vary depending on actual time taken, access conditions, additional services
required, or changes to job scope.
3. Booking & Acceptance
- Bookings may be made online or by phone.
- Online bookings require acceptance of these Terms and Conditions via checkbox.
- A booking is not confirmed until accepted by us.
4. Customer Obligations
You agree to:
- Ensure clear and safe access to the property at both pickup and delivery locations.
- Reserve and secure elevators, loading docks, parking permits, and loading zones where required.
- Declare all fragile, high-value, unusual, or heavy items prior to the move.
- Be present (or have an authorised representative present) during loading and unloading.
- Ensure goods are fit for transport and free of hazardous or prohibited materials.
Failure to meet these obligations may result in delays, additional charges, or refusal of service.
5. Prohibited & Restricted Items
We do not transport:
- Cash, jewellery, precious metals, or valuables
- Firearms, ammunition, or weapons
- Flammable, explosive, or hazardous materials
- Plants, perishables, or food items
- Illegal or restricted goods
We accept no liability for loss or damage to prohibited items if they are packed or transported
without our knowledge.
6. Insurance
6.1 Transit Insurance
- Comprehensive transit insurance is included in our services.
- Optional additional transit insurance may be available upon request.
6.2 Insurance Limitations
- Insurance coverage is subject to policy terms and exclusions.
- Items not declared, improperly packed, or owner-packed fragile items may not be covered.
- You are responsible for ensuring coverage is adequate for high-value items.
7. Damage, Loss & Claims
7.1 Reporting Damage
- Any damage or loss must be reported within 48 hours of service completion.
- Claims must be supported by photographic or other reasonable evidence.
7.2 Remedies
- Remedies (repair, replacement, or refund) will be determined on a case-by-case basis, at our
discretion, subject to Australian Consumer Law.
7.3 Exclusions
We are not liable for:
- Pre-existing damage
- Normal wear and tear
- Damage caused by poor access, customer-packed items, or undisclosed fragile items
- Delays caused by traffic, weather, building restrictions, or third parties
8. Australian Consumer Law
Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee,
right, or remedy under the Australian Consumer Law (ACL).
Where services fail to meet a consumer guarantee, you may be entitled to a remedy as provided
under the ACL.
9. Cancellation & Rescheduling
- To confirm booking, a security deposit equivalent to two (2) hours of service is required prior to the commencement of work. This amount will be adjusted against the final invoice upon completion of the job.
- Cancellations made more than 48 hours before the booking time incur no fee.
- Cancellations within 48 hours of the booking will incur a charge equal to two (2) hours of
labour.
- Rescheduling within 48 hours may be treated as a cancellation.
10. Delays & Force Majeure
We are not liable for delays or failure to perform services due to events beyond our reasonable
control, including but not limited to:
- Traffic incidents
- Weather events
- Accidents
- Mechanical breakdowns
- Industrial action
- Government restrictions
11. Payment Terms
- Payment is due in full upon completion of services unless otherwise agreed.
- We reserve the right to withhold delivery of goods until payment is received.
12. Limitation of Liability
To the extent permitted by law:
- Our liability is limited to the cost of repair or replacement of damaged goods.
- We are not liable for indirect or consequential loss, including loss of business or profits.
13. Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia, and the parties
submit to the exclusive jurisdiction of Queensland courts.
14. Amendments
We reserve the right to update or amend these Terms and Conditions at any time. The version in
effect at the time of booking will apply.
